Sarah Ferguson was accused in her absence at a hearing in a Turkish court.
She was charged with going ‘against the law in acquiring footage and violating privacy’ of the five children while filming undercover for a controversial documentary.
The crime carries a maximum term of 22 years in prison if convicted, although no trial date has been set.
The 52-year-old went to orphanages in Ankara and Istanbul in disguise with her daughter Princess Eugenie.
Posing as a wealthy Briton known as ‘Sarah’ and accompanied by potential ‘wealthy donors’, she made undercover videos to expose the ‘appalling’ conditions in state run orphanages.
It included footage of orphans dressed in rags and with shaved heads. Some of them were tied to their beds or left in cots all day.
Her footage, recorded for the Tonight show in November 2008, caused a diplomatic row.
The special edition led to outrage in Britain and claims of a smear campaign from the Turkish authorities.
Ferguson also filmed Romanian orphans. At the time of screening, she said: ‘I went as a mum, and I went because those children are silent whispers. And, quite frankly, I’m very happy, with [the] courage to stand by that film.’
It is not yet known why it took more than three years to file charges or whether a formal application for extradition has been made by Turkey.
The Foreign Office declined to comment.
