The “Gatherings Act”, undermining the constitution

Junie 29, 2012 in Sonder kategorie

I give full credit to Mike Smith for this explanation and words.

As it stands at the moment the Bill of Rights in the SA constitution says the following:

17. Assembly, demonstration, picket and petition Everyone has the right, peacefully and unarmed, to assemble, to demonstrate, to picket and to present petitions.

That means EVERYONE in the country..

However, public dissent and demonstrations are governed by the “Gatherings Act”.

According to this Act, the person who organizes a demo, is called “The Convener”. He has to notify the public authority about the demo and tell them amongst other things, the name and contact details of the convener, the purpose of the demo, time of the demo, route to be followed, anticipated number of demonstrators, etc.

This notice then gets sent 7 days before the demo to a “responsible officer” appointed by the local authority, who can refuse the demo after having a meeting with the convener. If the demo is prohibited and it still goes ahead, then it is a criminal offense. So this brings us to a few problems…

What if the demo is against the very local authority? What if the local authority is the ANC and they appoint the “responsible officer”? Obviously they will declare the demo prohibited.

This act is undermining the constitutional rights of the public. And in such cases the Constitution is always superior to any other acts.

Prof, elite sameswering, ek stem absoluut saam. Daai sameswering was seepglad gemaak deur groot hoeveelhede geld.

A bit more on laws and statutes

Junie 23, 2012 in Sonder kategorie

– The distinction between a law and a statute is that a law applies equally to us all but statutes can be made to favour one sector of society over others, for example, people with disabilities are given preferential parking privileges (which is fair enough) and politicians have given themselves special dispensations re their expenses which the rest of us do not have (which is outrageous).

 – There is a compulsion to obey laws. Laws defend our freedoms and liberties and through them we live in peace and harmony with our neighbours. Failure to comply with laws would render an individual an outlaw. If you do not respect the law then it can afford you no protection.

– Obeying statutes is voluntary i.e. with our consent. Any individual can withdraw their consent to being governed (controlled) by the statutes of a society. This might involve their exclusion from that society and the loss of benefits, but when the imposition of the liabilities outweighs the benefits, then that might be a price worth paying. The choice is and should be yours.

– Government is elected into ‘office’ not ‘power’ as they frequently like to claim.

– The ultimate constraint on the abuse of authority, (office) is the peoples ability to withdraw their consent to being governed – and at any time, not just at elections.

– It has become the habit of the legal profession to describe statutes as laws. Habits, no matter how entrenched do not however create facts. Statutes are not laws.

Why personal tax is unfair

Junie 20, 2012 in Sonder kategorie

Taxes paid by human beings on their salary or wage is morally not defendable in my view. Taxes should only be payble if an actual profit is realized and then only at rates as low as possible.

If a person exchanges his time and effort for a salary or wage, no profit was made by the one doing the work and spending the time. Clearly only an equal swap has taken place and nothing more.

Whether a salary or wage should even be called an income is another interesting question. Here is what a law dictionary says income is. Clearly there are things here where an equal swap takes place and then others where no swap takes place, but a clear profit is the result. How can all these then constitute income? it is clearly wrong.

From: Blacks law 8th addition

INCOME

The money or other form of payment that one receives, usu. periodically, from

employment, business, investments, royalties, gifts, and the like.

It is the right of any man to work and exhange his labour for that what he needs to support his family. How on earth could a right that is so crucial be taxable and why is it so important for governments to do this?

To me the answer is clear: To keep the masses poor and under constant control.

Uit die Amerikaanse howe:

“Income is realized gain.” Schuster v. Helvering, 121 F 2d 643.

“The word profit, as ordinarily used, means the gain made upon any business or investment-a different thing altogether from mere compensation for labor. There is a clear distinction between profit and wages or compensation for labor. Compensation for labor cannot be regarded as profit within the meaning of the law.” Oliver v. Halstead, 196 Va. 992.

“Reasonable compensation for labor or services rendered is not profit.” Laurendale Cemetary Assoc. v.

Matthews, 245 Pa. 239.

Blikskottel: Believe that a salary and wage should never be deemed income for tax purposes.

Iceland, I salute you.

Great little victories of ordinary people

While banks and local and foreign authorities were desperately seeking economic solutions, the Icelandic people took to the streets and their persistent daily demonstrations outside parliament in Reykjavik prompted the resignation of the conservative Prime Minister Geir H. Haarde and his entire government.

Citizens demanded, in addition, to convene early elections, and they succeeded. In April a coalition government was elected, formed by the Social Democratic Alliance and the Left Green Movement, headed by a new Prime Minister, Jóhanna Sigurðardóttir.

Throughout 2009 the Icelandic economy continued to be in a precarious situation (at the end of the year the GDP had dropped by 7%) but, despite this, the Parliament proposed to repay the debt to Britain and the Netherlands with a payment of 3,500 million Euros, a sum to be paid every month by Icelandic families for 15 years at 5.5% interest.

The move sparked anger again in the Icelanders, who returned to the streets demanding that, at least, that decision was put to a referendum. Another big small victory for the street protests: in March 2010 that vote was held and an overwhelming 93% of the population refused to repay the debt, at least with those conditions.

This forced the creditors to rethink the deal and improve it, offering 3% interest and payment over 37 years. Not even that was enough. The current president, on seeing that Parliament approved the agreement by a narrow margin, decided last month not to approve it and to call on the Icelandic people to vote in a referendum so that they would have the last word.

The bankers are fleeing in fear.

Returning to the tense situation in 2010, while the Icelanders were refusing to pay a debt incurred by financial sharks without consultation, the coalition government had launched an investigation to determine legal responsibilities for the fatal economic crisis and had already arrested several bankers and top executives closely linked to high risk operations.

Interpol, meanwhile, had issued an international arrest warrant against Sigurdur Einarsson, former president of one of the banks. This situation led scared bankers and executives to leave the country en masse.

Some helpfull cellphone tips

Junie 17, 2012 in Sonder kategorie

4 THINGS YOU PROBABLY NEVER KNEW YOUR MOBILE PHONE COULD DO!!! FOUR THINGS YOU PROBABLY NEVER KNEW YOUR MOBILE PHONE COULD DO!!!

There are a few things that can be done in times of grave emergencies… Your mobile phone can actually be a life saver or an emergency tool for survival.

Check out the things that you can do with it:

FIRST Emergency The Emergency Number worldwide for all Mobile Phones is 112. If… you find yourself out of the coverage area of your mobile network and there is an emergency, dial 112 and your mobile will search any existing network in your area to establish the emergency number for you, and interestingly this number 112 can be dialed even if the keypad is locked. This works on all phones worldwide and is free. It is the equivalent of 000.

SECOND Have you locked your keys in the car? Does your car have remote keyless entry? This may come in handy someday. Good reason to own a cell phone: If you lock your keys in the car and the spare keys are at home, call someone at home on their mobile phone from your cell phone. Hold your cell phone about a foot from your car door and have the person at your home press the unlock button, holding it near the mobile phone on their end. Your car will unlock. Saves someone from having to drive your keys to you. Distance is no object. You could be thousands of miles away, and if you can reach someone who has the other ‘remote’ for your car, you can unlock the doors (or the trunk).

Editor’s Note: I didn’t believe this when I heard about it! I rang my daughter in Sydney from Perth when we went on holiday. She had the spare car key. We tried it out and it unlocked our car over a mobile phone!’

THIRD Hidden Battery Power To activate, press the keys *3370# (remember the asterisk). Do this when the phone is almost dead. Your mobile will restart in a special way with this new reserve and the instrument will show a 50% increase in battery life. This reserve will get re charged when you charge your mobile next time. This secret is in the fine print in most phone manuals. Most people however skip this information without realizing.

FOURTH How to disable a STOLEN mobile phone? To check your Mobile phone’s serial number, key in the following digits on your phone: * # 0 6 # Ensure you put an asterisk BEFORE the #06# sequence. A 15 digit code will appear on the screen. This number is unique to your handset. Write it down and keep it somewhere safe. If your phone ever get stolen, you can phone your service provider and give them this code. They will then be able to block your handset so even if the thief changes the SIM card, your phone will be totally useless. You probably won’t get your phone back, but at least you know that whoever stole it can’t use/sell it either. If everybody done this, there would be no point in people stealing mobile phones. This secret is also in the fine print of most mobile phone manuals. It was created for the very purpose of trying to prevent phones from being stolen.

Also -ATM PIN Number Reversal – Good to Know!! If you should ever be forced by a robber to withdraw money from an ATM machine, you can notify the police by entering your PIN # in reverse. For example, if your pin number is 1234, then you would put in 4321. The ATM system recognizes that your PIN number is backwards from the ATM card you placed in the machine. The machine will still give you the money you requested, but unknown to the robber, the police will be immediately dispatched to the location. All ATM’s carry this emergency sequencer by law.

Kredietkaart ondervinding en so ietsie oor die Vatikaan

Junie 15, 2012 in Sonder kategorie

http://www.rt.com/news/tedeschi-vatican-vatileaks-banker-vatileaks-546/

Smaak my die Vatikaan se geld streke begin hom inhaal.

Eergister moes ek my nuwe kredietkaart by Standardbank gaan haal, aangesien die oue verval het.
