In every legal system the power to prosecute offenders is vested in the state. In South Africa the Attorney General and the public prosecutors have the discretion whether or not to prosecute, according to the Attorney-General Act 92 of 1992. As such, the principle of compulsory prosecution does not apply in the country.

 

Neither the executive nor the judiciary can interfere in exercise of this discretion by the Attorney General, according to Milton et al. (Van Wyk et al., 1994:411). Since the decision of the Attorney General not to prosecute results in the case not coming before a court of law, it means that the victim is denied his/her right to justice.

 

The danger of this situation is that the victim as the aggrieved party, may resort to illegal retaliation in his/her guest for justice.

The right enjoyed by the accused to have a legal practitioner assigned to him/her by the state ensures that

substantial injustice does not result in the case. Because the prosecutor represents the state in a criminal

case, the victim is left unrepresented. He/she has to deal, and cope, with the unfamiliar norms and

procedures, as well as the legal jargon of the court all by him-/herself. This may lead to the victim making

serious blunders in giving evidence, with the result that the accused may get an easy acquittal.

    Who do you feel should make the decision to go ahead a prosecute or not ?

  3. We don’t have to like this but it is not merely since 1994 that some cases do not get to court.

    Now it is hopefully only about legal evidence.. or evidence that could stand up in court

    and the way in which the police actually write up and present the case.

    There is no point in taking a case through trial if the defense can counter it easily because it is just a costly way to show that the victim or police do not have their ducks in a row for trial.

    In some instances a civil case with lesser evidence demands is the answer.

  5. In our legal system there is only criminals, accused and witnesses. Victims does not exist at all and you try do defend that position? You cannot be serious? Our constitution protect criminals but not victims and that is okay with you?

  7. I just belief there should be the status of victim in the courts as well. Prosecutions should not be decided without the input of such a victim. Plea bargains should never happen without the victim having the last word. We need to get back to a jury system, who will then decide if cases go on to the court. What we have now is absolutely sick.

  10. I fully agree with you, our “constitution” protects the criminals and not the victims. But since those in power are mostly criminals themselves – what can one expect?

  12. In RSA legal system, a victim does not exist and yes, I am doing something. I am educating people on this absolutely stupid and immoral fact of the “best constitution in the world”.

  14. In most countries the decision to prosecute will depend on the quality of the evidence available. The decision is usually up to the prosecutors.

  15. In RSA this is not entirely true, as the president an dothe rpoliticos decide on many cases, typically as can now be seen from all the reports coming from Thule Mdontsela. This all goes to Zuma first and that is WRONG!

  16. Blikskottel jy is regtig onkundig oor ons regstelsel. Doen moeite en gaan praat met n prokureur of n regsdosent. Jy stel duidelik baie hierin belang en dis goed, maar jy sal net soveel beter blog as jy die stelsel verstaan. Hierdie is regtig nie kritiek nie, net raad. As jy in die Suid Kaap kom vakansie hou laat my gerus weet. Ek sal n bier saam met jou gaan drink en soveel moontlik van die stelsel verduidelik as ek kan. Die stellings vervat in hierdie pos regtig net doodeenvoudig verkeerd.

  18. Snaaks genoeg doen ek wat jy voorstel al lankal en elke keer raak ek meer oortuig dat die “stelsel” daar is om die staat en regs geleerdes te dien en nie gewone mense nie. Natuurlik gaan julle dinge verduidelik om julle te pas, dis tog julle stelsel.

    Gelukkig is daar baie mense wat wel vry wil wees en meer wil weet en moeite doen om agter die waarheid te kom. Soos een prokureurs vriend..ek moet erken ek het sulkes, dit gestel het: mense soos ek is prokureurs se grootse vyande, net omdat ek ‘n sin vir geregtigheid het en nie stop voor die waarheid uitkom nie.

    Wat hier gepos is kom uit ‘n persoon wat regte studeer se MA disertasie en om eerlik te wees het ek al baie in die ding vas gehardloop. My eie sake kan ek as perfekte voorbeeld gebruik. Die kriminele was gevang, deur myself, gearresteer en nog steed het die hof se dienaars die saak nooit aanhangig gemaak nie..seker omdat dit vir hulle onbenullig was, maar my besigheid het amper onder gegaan.

    Vra die gewone man in die straat of hy dink die reg stelsel werk en die antwoord sal omtrent altyd nee wees. Gelukkig is meer mense besig om wakker te word en ook vrae te vra en kort voor lanl sal daar soveel wees dat nie die regs geleerdes, howe, politici of banke enige wegkruip plek sal oorhou nie.

    In USA se howe het dit al klaar begin inslag vind en dis net tyd voor dit hierso ook gebeur. Nou hier is my raad: Kyk bietjie uit die oogpunt van ‘n nie regsgeleerde na die stelsel en probeer verstaan hoekom dit nie reg werk nie.
